Cross-border bankruptcy cases filed in the U.S. under Chapter 15 of the Bankruptcy Code on behalf of foreign parties doubled during 2020 and are expected to set a record for 2021. Generally, Chapter 15 provides for a restructuring process involving parties in interest from more than one country and giving foreign creditors the right to participate in U.S. proceedings for bankruptcy cases filed outside the U.S. Our panel of experts will provide an overview of Chapter 15 and its purposes, jurisdictional and discovery issues, recent cases filed and restructuring strategies, as well as address questions from the audience.
